Redefining Terms Is An End Run Around the Legislature: More Reason Why Wisconsin Needs 2A Sanctuary

 

Recently you may have heard that the DOJ has seen fit to change the definition of words within the GCA (Gun Control Act-1968) and NFA (National Firearms Act-1934). This was done at the behest of President Biden, and as we have stated before, seeks to end-run the Legislature. Changing the meaning of a word within a piece of legislation is re-writing a law. Writing, re-writing, passing, and proposing legislation fall under the sole purview of the Legislature; the Executive and Judicial Branches are barred from making laws for a good reason, as separation of powers is necessary to avoid tyranny and consolidation of power.

The DOJ proposal states, “… The Department of Justice (“Department”) proposes amending Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) regulations to provide new regulatory definitions of “firearm frame or receiver” and “frame or receiver” because the current regulations fail to capture the full meaning of those terms. The Department also proposes amending ATF’s definitions of “firearm” and “gunsmith” to clarify the meaning of those terms, and to provide definitions of terms such as “complete weapon,” “complete muffler or silencer device,” “privately made firearm,” and “readily” for purposes of clarity given advancements in firearms technology…”

So, why is the DOJ’s proposal so dangerous?

1. If passed, this would set a precedent for executive agencies to completely re-write or alter laws.

2. The proposal would set a precedent to require Americans like you to become licensed FFL gunsmiths before you could modify your firearms.

3. The proposal would require citizens to be subject to a background check for firearms receivers, parts, and materials that historically have not needed a background check. It is an attempt to chip away at the 2A by making replacement parts extremely difficult to acquire. Also, it is setting a precedent for the DOJ to require a background check for anything they decide. The Executive branch could theoretically ban anything without consulting the Legislature. It would eliminate the right to Representation.

Wisconsin Gun Owners Inc. has always opposed NICS and background checks, not because we want criminals to acquire firearms, but because of the threat to legal gun owners and our 2A rights. The potential for abuse is too high, and the potential for expansion using unconstitutional means is too likely, as exhibited above.

You cannot let a thief in the house and expect them only to take your television. Unfortunately, though, the institutional gun lobbies love to talk about “compromise,” when compromise amounts to nothing more than the People being robbed of their rights while getting nothing in return.

If we are honest, we must see that a legitimate compromise consists of giving and taking. Yet, we have only seen more and more of our Liberty being taken away, with nothing in return.

The door to gun control has been opened, and it has been open season on our Second Amendment rights ever since.

In the past, Republicans have told us that we must compromise with groups that are no better than extortionists or that we would lose everything. Yet, now we find ourselves in a predicament where we are losing it all anyway. That is why WGO supports 2A Sanctuary for Wisconsin, and the sooner the better.

Rep. Pronschinske recently introduced the 2A Sanctuary bill AB293 and SB314, and the WSDFF Act is nearing introduction in the Assembly.

So, I bet you want to know why — with a Republican-held legislature — this bill isn’t fast-tracked and passed immediately? While the Biden regime continues its overwhelming push to abolish the 2A and use federal authority to target lawful gun owners, why are we still in legislative stagnation?

Well, “His royal majesty and his court,” Governor Evers and the WI-DNC have decided that they don’t have to do their jobs. Though, We The People hired these folks to represent and carry out the Will of the People. They are purposefully standing in the way of what Wisconsinites overwhelmingly want. 2A Sanctuary and the WSDFF Act are both wildly popular.

Yet, Evers has vowed to veto anything that even smells of the Second Amendment. Rumor has it that even if the Republicans agree to work with Evers to pass marijuana legalization (which would be a massive step to ending the unconstitutional “War on Drugs”), he has vowed to use his line veto to eliminate the Pro-2A parts of the legislation. This shows how the WI-DNC is the epitome of letting selfishness and self-interest stand in the way of what is in the People’s best interest and what the People want. I thought these were the guys who always talked about compromising? Now, there is an opportunity to set partisanship aside to end the War on Drugs AND the War on the Second Amendment, yet the WI-DNC still refuses.

Very telling.

It seems that when gun grabbers have to make a fair deal, rather than the usual putting us over a barrel and demanding everything, they cry FOUL!

Unfortunately, Gov. Evers has shown that Wisconsin’s best interests are not where his loyalties lie. Gov. Evers and Democrats in the Wisconsin legislature only swear allegiance to the will of their party.

This is why…We must DEMAND better, from both Republicans and Democrats!
